    not trying to argue anything lol im just saying brawl needs to find out another way how they gonna make there income. The info is out there now go get an sti or something

    You have provided a massive document with nothing hinting towards anything even related to the topic of pay to win. You fail to see how minecraft works.

    @NodusMyDownloads you have officially failed to realize what this forum is for. It's for talking about stuff with the server etc, instead you're spamming it with useless information about the EULA.

    @NodusMyDownloads is right. He is saying that the Eula, which is a binding contract, doesn't allow for servers to make money off of minecraft by selling modified minecraft code. Brawl does that, which is illegal, so minecraft can technically sue Brawl because they are violating the Eula. Brawl will have to change its source of income if it wants to continue to function. Also, there have been angry parents whose kids have stolen their parents credit card and spent a bunch of money on a minecraft server. These parents send an email to Mojang wanting a refund. Because Mojang doesn't own the minecraft servers, it can't do that. Mojang has gotten really tired of getting these emails and are finally doing something about it.

    SERVERS AND HOSTING
    With hosting servers we want to enable the community to make money by creating, hosting and maintaining servers for Minecraft, so you may do this subject to these Guidelines. You may have seen the Blog post on server monetization https://mojang.com/2014/06/lets-talk-server-monetisation/ and the follow up Q&A https://mojang.com/2014/06/lets-talk-server-monetisation-the-follow-up-qa. This section of these Guidelines clarifies them. By "server," we mean a single connecting address or IP number.

    Therefore, if you comply with and follow the Brand and Asset Usage Guidelines and Naming Guidelines above YOU MAY:

    • charge for access to your server, including a server which hosts your Mods, BUT only if:
      • you make a single charge per person that is the same for everyone;
      • you give everyone you charge, access to all the Mods that you choose to have on your server (except only in respect of genuine admin tools / admin Mods which should be reserved to administrators);
      • you only give access to your server to users who have a genuine paid for version of Minecraft;
      • you own or control the server and continue to do so for the whole time that you charge for access to it - so, if you sell the actual servers or server space with Mods pre-installed on them, you must ensure that the person buying the server is aware that she must follow these rules. Essentially you can't get round the rules above by setting up servers with Mods on and then selling those set-ups; and
      • overall your access charges should be targeted to cover your operational costs of running the server.
    • ask for donations (as opposed to direct charges) IF you do not offer the individual donor something in exchange that only he or she can use. You may offer server wide rewards if donation goals are achieved though.
    • sell cosmetic items, except for "Capes", IF the item sold does not give a user an unfair gameplay advantage over anyone else on the server - i.e there can be no "pay to win".
    • sell positive effects or enhancements (other than "Capes") IF everyone on the server is positively affected in exactly the same way.
    • provide in-game advertising opportunities, sponsorships, or product placement for 3rd parties IF they don't degrade or interfere with gameplay or give a user an unfair gameplay advantage over anyone else on the server.
    • use in-game currencies IF (i) they are "soft currencies" i.e. a currency earned or expended only through gameplay that has no real world value and that cannot be cashed out, used or transferred across free or paid servers, or converted into "credits"; and (ii) you don't give the impression that it comes from or is associated with Mojang.
    Essentially, you can't sell anything that changes gameplay. Which brawl does. This has never been enforced, but if it begins to be, we are screwed.

    War is mostly P2W. Proof: I voted and got the best guns and I rekt people on war even though my aim is awful.

    This is pretty much it all that it's violating unless the gambling in wild west technically violates the EULA. :V I must say though, that the language used here is pretty vague. What does "unfair advantage" mean? The word "unfair" is vital here. They didn't simply say advantage as would insinuate any advantage whatsoever. They said "unfair advantage." What is an "unfair advantage?" As far as "pay to win" goes, I would say that Brawl's servers are for the most part good when it comes to it. The only really issues I see are warps in WarZ and scavenger in War. The rest (I can't speak for HG or CTF) seem pretty fair. Therefore, these perks donated for give a slight advantage, but not an "unfair" one. However, that's just my opinion. The wise choice would be to not split hairs and play it safe, but that decision isn't up to me to make. The whole ONLY COSM part of the EULA seems completely unreasonable to me. It favors large servers and hinders smaller, perhaps revolutionary ones from every being created. It's like how government red tape screws small businesses over. I think that it was a huge mistake and should never be enforced. However, should they do so, what can we do about it? I doubt that Brawl will ever follow the EULA unless they are forced to. Until then, taking into account how absurd I think this section of the EULA is, I don't care if they don't follow it. It's not my problem. If Brawl gets into legal trouble, that's their fault for not following the EULA. With any luck, if Microsoft enforces the EULA, hopefully it blows up in their faces and they take it back. Don't expect to see me shedding any tears for Microsoft. :V

    Mojang makes it pretty clear in their explanation of intentions that no items that aren't cosmetic are to be sold for profit. They haven't enforced anything yet but if they do, expect large servers to be on the top of the list. They have a right to pretty much enforce their EULA any way they want unless a judge decides otherwise. As long as they stick to what's posted they can do what they want.
