Not on all versions of it. A friend of mine got banned for it. M1guel used it in his video and it held while he opened his inventory resulting in a ban.

If this is true than he's using a bannable togglesneak that is different from the labymod one

People use different versions of minecraft during different months.

LabyMod with that togglesneak is not only disallowed but, depending on your source, may be RAT'd and skidded (aka may be a LabyMos client)
